Monica Fitzgerald Oathout is a native of New York, who was raised in Maine, and educated in Houston. She is married to Mark Oathout, an intellectual property attorney and has three teenagers. 

Monica practiced with the Houston office of Thelen, Marrin, Johnson & Bridges from 1987 to 1990. In 1990, she joined what is now known as Schwartz, Junell, Greenberg & Oathout, L.L.P. Monica has been a partner since January 1995. She has handled a docket of toxic tort defense, insurance coverage, employment cases, commercial litigation, professional malpractice, and general civil litigation. Additionally, she has lectured on "Minimizing Sexual Harassment Liability," "Expert Witnesses Under the New Rules," "Expert Witness Discovery" and "Employment Torts: Defamation, Intentional Infliction of Emotional Distress, Invasion of Privacy, Fraud, Negligent Supervision, Negligent Referral, and Negligent Hiring," "Amendments to the Americans Office Disabilities Act," and "Family Responsibilities Discrimination" at seminars for employers, human resources personnel, and practicing attorneys.

Monica is admitted to practice before the United States Supreme Court, the Texas Supreme Court, all other Texas state courts, the United States District Courts for the Eastern, Western, Northern and Southern Districts of Texas, the United States District Court for the Western District of Louisiana, and the United States Court of Appeals for the Fifth Circuit.

Currently, Monica is serving a two-year term as President of the International Alliance of Law Firms, a network of mid-size firms with members in forty countries. Monica is also a member of the American Bar Association (Litigation and Labor & Employment sections), Houston Bar Association (Litigation section), the State Bar of Texas (Litigation and Labor & Employment sections) and the Texas Bar Foundation. Additionally, Monica has served as a Director for the University of Houston Law Alumni Board of Directors, the Houston Bar Association Habitat for Humanity Co-Chair and the Cystic Fibrosis Sport Challenge Committee Co-Chair.
